President Donald Trump says voter ID rules will be in place for the 2026 midterm elections, with or without Congress.
In a Friday post on his social media platform, Trump vowed to issue an executive order if lawmakers fail to pass new election legislation. He argued that voter identification is necessary to prevent what he called election “cheating,” though he offered no evidence of widespread fraud.
“There will be Voter I.D. for the Midterm Elections, whether approved by Congress or not,” Trump wrote.
What the SAVE America Act Would Do
Trump’s comments come after the House narrowly passed the SAVE America Act this week. The bill would require voters to present photo identification at polling places and would mandate that states obtain proof of citizenship before registering someone to vote in federal elections.
The legislation now faces an uncertain future in the Senate. Senate Minority Leader Chuck Schumer called the bill “dead on arrival,” saying it would make it harder for Americans to vote.
“It’s a fringe piece of legislation,” Schumer said in a February 9 statement before the House vote, arguing it lays groundwork to interfere in future elections.
Claims of Fraud and the Evidence
Trump and many Republican lawmakers argue that stricter voter ID laws are necessary to protect election integrity. However, multiple studies and audits have found little evidence of widespread voter fraud.
For example, a voter roll audit in Georgia before the 2024 elections found 20 registered noncitizens out of 8.2 million voters. Only nine cast ballots. State officials have publicly reported those findings.
The Cybersecurity and Infrastructure Security Agency has repeatedly stated that U.S. elections are secure and that there is no evidence of systemic fraud. Its guidance is available at cisa.gov.
Executive Order Faces Legal Hurdles
Trump has previously tried to reshape election rules through executive action. In March last year, he signed an order titled “Preserving and Protecting the Integrity of American Elections.”
That order directed the Election Assistance Commission to require documentary proof of citizenship on federal voter registration forms. The commission operates under federal law outlined at eac.gov.
Several lawsuits quickly challenged the order. In April, U.S. District Judge Colleen Kollar-Kotelly ruled that the president had exceeded his authority.
“Our Constitution entrusts Congress and the States—not the President—with the authority to regulate federal elections,” she wrote in her decision.
Constitutional Debate Ahead
The Constitution gives states broad authority to run elections, with Congress holding oversight powers. Legal experts say any attempt to impose nationwide voter ID requirements by executive order would likely face immediate court challenges.
Trump has argued that if states fail to manage elections properly, the federal government should intervene. He repeated that position earlier this month during remarks from the Oval Office.
With the Senate divided and midterm campaigns already taking shape, the fight over voter ID is poised to become one of the most contentious issues of the 2026 election cycle. Whether through legislation or executive action, the legal battle appears far from over.
